1. Agreement
By creating a BotWave account or using any part of the BotWave platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and BotWave Intelligence Systems.
2. Service Description
BotWave provides an AI-powered WhatsApp automation platform that enables businesses to:
- Deploy an AI chatbot on their WhatsApp Business number.
- Automate customer support, FAQ responses, lead capture, and order collection.
- Broadcast messages to opted-in contacts within plan limits.
- Manage conversations, leads, and orders via a web dashboard.
The Service is provided on a subscription basis. Features available to you depend on the plan you have subscribed to.
3. Account Registration
You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. You may not share your account with others or create multiple accounts to circumvent plan limits.
4. User Responsibilities
You agree that you will not:
- Use the bot to send spam, unsolicited commercial messages, or bulk messages to users who have not opted in.
- Use the Service to harass, abuse, threaten, or defame any individual or organisation.
- Use the Service to distribute illegal content, malware, or fraudulent material.
- Reverse-engineer, scrape, or attempt to extract the underlying AI systems or source code.
- Violate WhatsApp's Terms of Service or Meta's policies while using the platform.
- Use the Service for any activity that is illegal under Indian law.
- Misrepresent your identity or impersonate other businesses or individuals.
You are solely responsible for all content sent through your bot and all interactions with your customers.
5. Anti-Spam Policy
BotWave has a strict zero-tolerance policy for spam. You may only broadcast messages to customers who have voluntarily messaged your bot and are thus opted-in contacts. Any account found to be engaged in spam activities will be immediately suspended without refund.
6. Subscriptions & Payments
Subscription fees are charged in advance on a monthly or annual basis. Payments are processed securely by PayU. By subscribing, you authorise us to charge your payment method on a recurring basis. Plan upgrades take effect immediately. Downgrades take effect at the next billing cycle.
7. Account Termination
BotWave reserves the right to suspend or permanently terminate your account at any time, without prior notice, if:
- You violate any provision of these Terms.
- Your account is used for spam, illegal activities, or abuse.
- Your subscription payment fails and is not resolved within 7 days.
Terminated accounts are not eligible for refunds, except as outlined in our Refund Policy.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or that AI responses will always be accurate. BotWave is not liable for any loss of business, revenue, or data arising from use of the Service.
9. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts in India. We encourage amicable resolution — please contact us first before initiating any legal proceedings.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on your dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.
